Managing Principal John C. Jarosz, along with affiliate Jorge Contreras, will present at the 2021 IPSC, “Irreparable Harm in Patent Preliminary Injunction Cases.” They will discuss, based on their evaluation of 200 district court opinions, the test for preliminary injunctive relief, the rate at which such relief is granted, the importance of irreparable harm in that test, and factors that are considered in evaluating irreparable harm. They will go on to propose a four-element test to determine whether irreparable harm should be granted, with that test tied to sensible economic principles. They will finish by describing how irreparable harm should be considered in the broader context of determining whether a preliminary injunction should be granted.
